各位:

移工團體「亞太移工組織」(Asia Pacific Mission for Migrants, APMM)「移工國際」(Migrante International)等團體,將於六月三日(週日)下午2:00於勞委會前,針對基本工資調漲之事,進行陳情。移工們將向勞委會呈遞一份超過一千名移工連署的陳情書,並期待勞委會的正式回應。

移工團體要求全體勞工,不分本地與外勞,一律調漲基本工資,並要求將家戶勞動者一併納入基本工資調漲的範圍。

現場將有多位移工代表和本地聲援者到場。歡迎各位關心本勞及移工權益、支持基本工資調漲的朋友們到現場聲援、支持!

以下是移工的訴求內容:

提高台灣所有勞動大眾的基本工資及實際薪資所得!

基本工資調漲應包括家庭雇用移工!
廢除對雇用家庭服務移工之雇主強制徵收費用!
實施強制直接聘僱家庭服務移工!

拒絕調漲食宿費用及其他強制移工繳納的費用!
停止對移工的薪資強制高額扣款!

我們支持本地勞工要求調漲基本工資與實際薪資所得的訴求。

同時,我們要再次強調提供家戶服務,擔任看護或家庭幫傭的移工不應該被排除在基本工資調漲政策之外,我們反對調漲食宿費用及其他強制移工繳納的費用,我們也反對針對移工的薪資強制高額扣款。

2002年實施的《勞基法》規定,以扣除每個月2,500至4,000不等的食宿費用為由行扣薪之實;此外,仲介經常以每月仲介服務費為名,強制收取管理費。以移工在台灣可工作的最長時限六年來說,以上費用平均每個月便要收取1,583新台幣,而印尼籍移工每個月還會被苛扣6,703新台幣的安置費用長達十五個月。

然而,家庭服務勞工為台灣社會貢獻良多。她們認為政府與那些需要協助的家庭是她們的責任,家庭勞工減輕許多台灣家庭成員的負擔,讓他們可以投入職場或從事其他活動,這些勞工在台灣生活的同時,也對台灣的經濟發展有所貢獻。

除此之外,移工原本就要負擔前述的許多費用,這些費用也已從他/她們的薪資當中扣除,因此他/她們不含加班費的實際收入,僅有目前基本工資的38%至76%。

由於部分雇主及企業主將反對基本工資調漲,也由於台灣政府已經私有化這項重要的服務項目,我們提出以下訴求:

1. 廢除雇主雇用外籍家庭服務勞工必須繳納的費用,如此一來便足夠負擔家戶勞工應得的基本工資調漲。每個月2,000新台幣的收費高出基本工資調漲幅度。

2. 實施家庭服務移工及其他種類移工直接聘僱制度。目前菲律賓與台灣官方簽訂「台灣特別聘僱計畫」,但這項計畫僅適用於重新聘僱而非強制。如果實施直接聘僱,雇用移工對雇主而言將會更節省經費,而且如果廢除目前不健全的制度,移工的基本工資也會較現行薪資高。

Increase the Minimum Wage and Take Home Pay of All Working Peoples in Taiwan!

Include Migrant Household Service Workers in the Impending Minimum Wage Hike! Abolish the Levy on Employers Hiring Migrant Household Service Workers! Impose Mandatory Direct Hiring on Migrant Household Service Workers!

No to Any Increase in the Board and Lodging and Other Fees Imposed on Migrant Workers! Stop the Exorbitant Mandatory Deductions on the Pay of Migrant Workers!

We support the local workers aspirations to further raise the minimum wage and their take home pay.

At the same time, we are against excluding migrant workers toiling in homes as caretakers and domestic helpers from the basic wage hike and to any increase in the board and lodging and other fees of other foreign workers. We are also against any exorbitant mandatory deductions on the pay of migrant workers.

This includes a wage cut in the guise of board and lodging fees of from NT$2,500 ¡VNT$4,000 a month on those covered by the Labor Standards Law, which was implemented in 2002. And the imposition of a management fee in the guise of monthly brokers service fees also imposed in the same year as the above. This averages NT$1,583 a month for a six year period. Indonesian migrants on the other hand are further deducted a maximum of NT$6,703 a month for 15 months as placement fees.

At the same time, household workers contribute a lot in rendering services to the Taiwan community and society. It relieves the government and even the families of those who need to be taken cared of their responsibility to do this task. Household workers also liberate other members of Taiwanese families from this heavy work to join the working force or in pursuit of other activities. These workers also contribute in consumer spending that is good for the Taiwan economy.

In addition to these, migrant workers are already burdened by a lot of fees as mentioned earlier, which are deducted from their salaries. They actually get only 38% - 76% of the present minimum wage excluding overtime pay.

Since a number of employers would be hard up in footing a wage hike and since the Taiwan government has privatized this essential service, we also propose the following:

1. Abolish the levy on employers who hire foreign HSW. This alone would be enough to pay for the increased minimum wage the HSW also deserve. The NT$2,000 a month levy is bigger than the proposed wage hike.

2. Impose mandatory direct hiring on HSW and all other migrant workers of all job categories. Right now, there is a Special Hiring Program for Taiwan (SHPT) between the Philippines and Taiwan. But this is only for rehires and is not mandatory. If this were imposed, hiring migrant workers would be cheaper for employers. At the same time the migrant workers¡¦ basic wage would increase if this legalized form of extortion imposed on them were removed.
